  1. To avail the facilities offered on our Platform, you will have to create a Login ID using your mobile number or email id and Password.

Additionally, for availing or registering for any services on our Platform where a pay-out may or may not be required, we may collect your Name, Date of Birth, Telephone number, Postal/Contact address, bank account details, and PAN number. We may also collect information about your social media handles including but not limited to Facebook, Instagram, Twitter, LinkedIn, Google etc., PAN number, picture of any of the government issued photo identity and address proof including but not limited to driving license, voter ID, Aadhaar card, passport and other associated details required for your KYC form, contact details from your mobile address book, and details of your WhatsApp profile (collectively, “Account Information”).

  1. PathoGenie collects and stores any information which you enter on our Platform. This information is normally collected when you search, request information, or buy, participate in a contest, social media interactions, or fill the on-line survey, or when you communicate with any of our departments such as customer service, sales through our Platforms, telephone, mail, email, text, chat, fax, paper documents or in-person. When personal data is provided in this manner, it may be stored in paper files or entered computer systems for retention.

  1. In addition, you might voluntarily submit additional information including profile pictures, nick names, social media profiles, Aadhar number etc.

  1. The customer information entered by you is treated as information in custody for which you shall be the data owner or data controller.

When you use our Platform, certain information may also be automatically collected and stored, including the IP address of your computer, browser type and language, the date and the time during which you accessed the site, UDID and MAC data, geo-location data, the address of the Platform which you may have used to link to Platform and other relevant information from your device and/or other Platforms.

This may include bank account numbers, billing and delivery information, credit/debit card numbers, expiration dates and security code and tracking information from cheques or money orders to facilitate the sale and purchase as well as the settlement of purchase of the goods or services transacted on or procured through the Platform.

  1. We will collect contact details and other information of Users from publicly available sources for the purposes of verifying the Users and performing due diligence on the Users.

We will collect details of User activities, transactions and interactions on the Platform including information relating to the types and specifications of the products and services purchased, pricing and delivery information, dispute and complaint records, communications between Users and any information disclosed in any discussion forum.

  1. We will also automatically collect all information related to Users communications with its customers and store such data as a custodian and use such data as mentioned in clause 3 of this Privacy Policy.

  1. Platform may also use software applications or specially created codes for Platform traffic analysis and to gather statistics used for advertising and for determining the efficacy and popularity of our Platform among others.

We collect information about your use of our services, such as Platform usage, log files, User activity (e.g., pages viewed, the amount of time spent on particular pages, online browsing, clicks, actions, time stamps, alerts, etc.). This information is collected for amongst other things troubleshooting errors and bugs as well as for research and analytics purposes about your use of the services.

We may collect Personal Information from third party service providers, such as information about your credit history from credit agencies and other financial information, which is relevant to the provision of our services, as well as information which is gathered in order to verify your identity and prevent fraudulent or illegal activity.

Collecting this information enables us to better understand the visitors who come to our Platform, where they come from, and what content is of interest to them.  We use this information for our internal analytics purposes and to improve the quality and relevance of our Platform. Some of this information may be collected using cookies and similar tracking technology, as explained further under the section “COOKIES” below.

We may receive personal information about you from third parties that are engaged by us to assist with providing verification services and conducting suitable money laundering and KYC (know-your-customer) checks on Users. This may include your name, email address, company details and contact information among other things among other things

  2. Setting up / administering User accounts, including providing log-in IDs and developing a User profile.

For providing Users with customer service support, responding to queries, feedback, and managing claims and/or disputes, We may use your Personal Information or any such information provided by you over a course of time for purpose of the functions mentioned in clause 3 of this document. It is also to be understood that we may have to share such information with third-party for the purpose of catering to these functions. We may also use the provided information for auditing and analysis purposes with the aim of improving our services;

  1. Facilitating communication between Users and the Platform, processing transactions and settlement made over the Platform. It has to be expressly stated here that we believe that you have given your consent to receiving communication from us when you provide us with any kind of contactable information, this may include email, phone, address etc. We believe in complete transparency and hence we would like to state that any contact information provided by you of any of your contacts as referral or otherwise shall be used to send out communication to that person on your behalf and the correspondence may carry your contact information as the address from which such communication is sent;

  1. Personalizing our marketing and communications with you based on your browsing records, and your order history. We shall also want to state that PathoGenie also conducts periodic analysis and survey of the traffic of our Platform for market research and advertising purposes, the information provided by you may be used for such activities. We may use third-party agencies or companies for such activities of conducting surveys or research and will have to share the information provided by you with such companies for the said purposes. We may also use your transaction and browsing history including the activities associated with it such as money deposited or withdrawn etc for the purpose of analysis. This may be done for various reasons and will help us improve graphical displays, analyse user feedback, or to perform analytics and marketing either by us or by the companies engaged for this purpose.

  1. Performing research or statistical analysis in order to improve the content and layout of the Platform, and to improve the product offerings and services on PathoGenie, including, for example, using anonymized data for machine learning purposes.

  1. Performing research or statistical analysis on the User’s customers data that is kept in custody. Such research and analysis are done with the objective of building business intelligence that maybe offered as a service.

 

  1. We may also use your personal information for other purposes that are not incompatible with the purposes we have disclosed to you (such as archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes) if and where this is permitted by applicable data protection laws. Additionally, PathoGenie is mandated as per section 6 of Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 to share personally identifiable information if sharing of such information is necessary to comply with legal processes or governmental request. We may also share your personal identifiable information with the Judiciary or the Government in order to enforce the Terms of Use and this Privacy Policy or for prevention of fraud or for issues involving security or to protect your rights or rights of PathoGenie or the rights of the general public.

 

  1. If PathoGenie should ever file for bankruptcy or become insolvent, or be acquired by other company or merge with some company or sell all or part of its assets or transfer substantially all or part of our relevant assets to the new company, we are entitled to share all the information you have provided and the information we have collected as defined in this Privacy Policy to such organization, company, investment and merger partners.

  1. DISCLOSURE OR SHARING OF PERSONAL INFORMATION

We may disclose (or provide access to) personal information to the following categories of recipients and third-party business partners, service providers and or affiliates of PathoGenie, engaged by us or working with us to assist us to provide services to you or who otherwise process personal information for purposes described in this Privacy Policy or notified to you when we collect your personal information.  Categories of these partners or service providers include but are not limited to:

  1. If you self-schedule the payment, we use a secure scheduling form which requires you to provide contact, billing, and financial information. This information is transmitted to your credit card company to authorize your purchase. At certain times we may offer financing options with or without third-party participation. If you use a financing option information provided by you (such as your address, birth date, Aadhar card number, PAN card number and credit card number) may be used to request a credit report from third parties or may be sent to a third party for processing.

  1. We may have established relationships with third parties and Platforms to offer you goods and or services which we do not offer, and such third parties and Platforms offer. We offer you access to these other parties and their Platforms either through the use of hyperlinks to these sites from our Platform or through offering "co-branded" sites in which both we and other parties share the same uniform resource locator (URL), domain name or pages within a domain name on the Internet. In some cases, you may be required to submit personal information to register or apply for products or services provided by such third parties or co-branded partners. This Privacy Policy does not apply to these third-party sites or co-branded sites. The privacy policies of those other parties may differ from ours, and we have no control over the information that you submit to those third parties. You should read the relevant privacy policy for those third-party sites and co-branded sites before responding to any offers, products or services advertised by those parties.

  1. USER’S RESPONSIBILITY

  1. All registered accounts are protected by means of login information which includes a mobile number and a password that is known only to the User. Therefore, the Users are responsible for maintaining the confidentiality of login information including the credentials.

  1. We suggest you do not disclose or share, even in confidence, your login credentials to anyone. In an event where you become aware of or reasonably suspect any breach of security, including compromise of the login information, it is your responsibility to immediately notify us via the email on support@pathogenie.in of such breach so that appropriate action as required can be taken. If by any means it is discovered that you have knowingly and wilfully shared these details, PathoGenie shall not be responsible for any loss or damage or consequences that may occur to you in whatsoever way possible from such breach of information to any party. However, PathoGenie reserves the right to take appropriate actions of such breach under relevant laws as may be applicable.

  1. Our Platform may contain links to other Platforms or apps, such apps and Platforms are governed by their own privacy policies, and we do not exercise any control over them. Hence it becomes the responsibility of the Users to read and understand the privacy policy of such Platforms before following a link outside our Platform. PathoGenie cannot be held accountable for the privacy practices or the content of such Platforms.

  1. PathoGenie offers services specifically to business partners who are into health services and other services relating to it and not for general audience. We reserve the right to access and verify the User’s Personal Information and their customers information at any point, however the responsibility for submitting any incorrect personal data remains with the User.

  1. Data which is transmitted over the Internet is intrinsically exposed to security risks or threats. For instance, information transmitted via chat or email can be compromised and used by others. Therefore, we cannot guarantee any security for such information.

  1. CONSENT

  1. We understand that you have provided your express consent by signing up for use of our Platform, we acknowledge your patience and appreciate you reading this Privacy Policy before signing up. This express consent includes you as well as your staff, agents, and suppliers for use of our Platform to access services or simply browsing. We further would like to express our gratitude for allowing us to collect and use the information as listed in this policy.

 

  1. In order to use the services that are being offered on our Platform, you shall be required to transact money. However, we would like you to know that such transactions are done using a third party payment gateway providers or financial institutions. We need to share your information including your sensitive personal information and personal information with these third party payment gateway providers or financial institutions in order to process such transactions, while we take necessary steps in order that your data is always protected, we are dependent on these third party providers and hence cannot guarantee any kind of protection as the scope is beyond our control.

 

  1. You expressly consent to our sharing of your information with our Auditors, Contractors or any other third party in connection with this Agreement.

 

  1. The age eligibility for use of our services on the Platform is minimum of 18 years and we further reserve to verify any information provided in connection with this criterion. We also reserve the right to stop complete access to all services with immediate effect without notice to the extent that your account with us may be cancelled, in event that we find out or it comes to our notice directly or indirectly that the information provided is false, fake, or fraudulent.

We also reserve the right to validate your identity, age, the registration data provided by you and to verify your use of the services and your financial transactions for potential breach of our Terms of Use and of applicable law. By using our Platform, you authorize us, our staff, agents, and suppliers to use your Personal Information and to disclose your Personal Information to third parties for the purposes of validating the information you provide to us.

  1. The mobile number provided by you during registration shall be used by PathoGenie and its affiliates, employees and third parties to communicate with you in regard to the duties they are assigned or need to perform to offer you a seamless experience on the Platform which may include but is not limited to updates, notifications, or promotional activities.  However, we shall not share your number with any third party without them needing to be provided with the mobile number to perform their duties.

 

  1. It is expressly stated by PathoGenie and understood by you that use of ‘Bot/s” or any kind of automated programs that enable artificial or non-human intelligence to use any of our service is prohibited and we reserve the rights to add features on our Platform which are designed to detect use of such programs. By registering on our Platform you expressly consent to such features of our Platform. The features may include scanning of active software and processes along with files and Platform related folders to ensure that only ‘non-hacked’ versions of the Platform is being used. We further clarify that in an event where a suspected application or process and compile a composite mesh (i.e. a profile that characterizes the files associated with the application or process) is matched against profiles for known illicit automated programs, we shall scan the files and decide the further course of action including but not limited to restricted access or deletion of the account.

 

  1. However, you can be certain that our software will not perform any random search of your hard drive or files and will not attempt to transmit any information to us or a third party other than as agreed in this Privacy Policy or our Terms of Use.

  1. RETENTION

  1. We retain your personal information as long as we have an ongoing legitimate business need to do so.

  1. We keep some of your data even after you close your account or deregister with us or when your service contract is over.

  1. If you choose to deactivate your account or discontinue the services, your personal data will generally be stop being visible to others on our Platform within 15 days. We generally remove information and profiles within 15 Days of account closure and this information will no longer be visible.

  1. Information you have shared with others (e.g. Through Inbox, emails, posts etc.) will remain visible after you closed your account or deleted the information from your own profile or mailbox, and we do not control data that other Members copied out of our Services.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Users, who believe they are receiving our communications in error or no longer desire to receive them, should inform us and we will remove those users' names from our mailing lists. PathoGenie will be judicious in the use of e-mail and paper mail to communicate with users.

  1. PathoGenie makes all user information accessible to its employees, agents or partners and third parties only on a need-to-know basis, and binds only its employees to strict confidentiality obligations.

  1. PathoGenie provides access to this Platform that enables doctors, technicians and other para-medical and support staff to store, maintain and organise such information. PathoGenie may, therefore, retain and submit all such records to the Government, Regulator or such appropriate authorities who request access to such information.
